Resumo: o presente artigo tem como objecto de estudo, a posição hierárquica do Direito Internacional na ordem jurídica moçambicana. A Constituição moçambicana estabelece os princípios da constitucionalidade e da supremacia da Constituição e da consequente subordinação do Estado à Constituição da República, com a prevalência das normas constitucionais sobre as restantes normas do ordenamento jurídico. No presente artigo procuramos aferir a posição hierárquica das normas do Direito Internacional na ordem do Direito Internacional na ordem jurídica moçambicana, face por um lado dos princípios da constitucionalidade, soberania nacional e supremacia da constituição e por outro com a emergência do constitucionalismo supranacional face crescente globalização e integração regional, criando uma ordem constitucional internacional.

Abstract: the present article aims at studying, the hierarchical position problem of the International Law in the Mozambican legal order. The Mozambican Constitution establishes principles of constitutionality and constitution supremacy and the consequent State subordination to the Constitution of the Republic, with current Constitutional Norms over the rest of Legal System Norms. In the present article, we seek to evaluate the Hierarchical position of the International Law Norms in International Law order, in Mozambican Legal Order, given on the one hand, the constitutionality principles, National Sovereignty and Constitution supremacy and on the other hand, the merging Supra-National Constitutionalism due to the crescent globalization and regional integration, creating an International Constitutional Order.
